Brief Facts of the Case

The plaintiff, in good faith and on account of personal friendship, extended a substantial loan to the defendant to rescue him from severe financial distress. In acknowledgment of liability and towards repayment of the outstanding amount, the defendant issued a cheque. However, the cheque was dishonoured upon presentation, compelling the plaintiff to initiate criminal proceedings.
